Under the Individuals with Disabilities Education Act (IDEA) and the New York State Education Law, students with disabilities are entitled to receive a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE). Gorczynski is dedicated to assuring that your school district properly refers, evaluates, identifies, and services the individual education needs of your child so that he or she can receive educational benefit.
Also students who may or may not qualify for an Individualized Education Program (IEP) under the IDEA, may be entitled to receive accommodations and/or services pursuant to Section 504 of the Rehabilitation Act. Student’s rights under Section 504 are often misunderstood and overlooked. Gorczynski can champion your children’s rights and assure that they do not “slip through the cracks.”
Children with autism, intellectual disabilities, specific learning disabilities (including dyslexia), emotional disabilities, as well as children who are deaf, blind or speech or language impaired, or even children with a physical or medical disabilities are entitled to a FAPE. Gorczynski has the experience to help you advocate for your children’s rights. In many cases, the school district could be responsible for payment of your legal fees.
